Choosing bankruptcy relief

Consumers can file either a Chapter 7 (Discharge) or a Chapter 13 (Wage Earner) plan. Both will help to stop collection actions against you, including harassing phone calls and letters, foreclosures, garnishments, repossessions, and more. It will also stop almost all civil lawsuits against you. Which Chapter you will file will depend on your unique financial circumstances. The Law Offices of M. Bankruptcy will go into effect immediately upon the filing of the petition and the associated fee with the court. At that point, federal law orders an Automatic Stay on most, if not all, collection activity. The court will also mail out notices to all your creditors.

 

Chapters 7 and 13

Chapter 7 allows you to discharge (eliminate) most, if not all, of your unsecured debt (medical bills, credit card, unsecured loans, etc.) In almost all cases, you may keep your house, automobile and personal possessions. You are typically allowed to continue your house and car payments to the lender.

 

Chapter 13 (Wage Earner Plan) reorganizes your debt to allow an affordable payment plan to the Trustee. You are usually able to keep your property and personal possessions. This plan allows you to catch up on past due auto or home loan payments, stop foreclosure and repossessions, while it is also very helpful to help arrange the payoff of past due taxes, child support and student loans.

 

Bankruptcy alternatives

You have made your best efforts to repay your debt. Many of you have refinanced your home on one or more occasions. Many of you have cashed out your lifetime’s savings, or borrowed against your 401K, IRA or other retirement accounts. Many of you have sold much of your personal assets to stay afloat. Many of you are sacrificing precious time with your spouse and children to work overtime or second, even third jobs. Many of you have borrowed money from family and friends, some of whom may themselves be in financial distress without your knowledge. Many of you have looked into credit counseling, or may even be involved in such a program at this very moment. The fact remains that realistic alternatives are slim for most. The reality is such that if you, an honest debtor, have a realistic ability to become debt free in the foreseeable future, you would not be considering filing bankruptcy.
